Character AI, a platform allowing users to roleplay with AI chatbots, has filed a motion to dismiss a lawsuit brought by Megan Garcia, the mother of a teen who tragically died by suicide.

Megan Garcia, the plaintiff, claims her son became increasingly isolated, texting Dany compulsively before taking his own life.
The suit accuses Character AI of failing to implement safeguards to protect vulnerable users, especially minors.

Character AI’s motion to dismiss hinges on First Amendment protections. Its legal team argues that interactions facilitated by AI chatbots qualify as protected speech, comparable to how computer code has been recognized as a form of speech.
“The First Amendment prohibits tort liability against media and technology companies arising from allegedly harmful speech, including speech allegedly resulting in suicide,” the filing states. “The only difference here is that some of the speech involves AI.”
The company also contends that Garcia’s demands could infringe on users’ rights by imposing restrictions on the platform’s expressive capabilities, warning that the case risks setting a precedent that could stifle freedom of expression in generative AI.
Section 230 and Legal Ambiguities
Interestingly, Character AI’s defense does not directly invoke Section 230 of the Communications Decency Act, a law that traditionally shields online platforms from liability for third-party content.
